Spousal maintenance is a form of income paid by one spouse to the other when they separate.
It’s paid at a certain level and for a certain amount of time.
How much and for how long is different in every case.
Not every spouse is entitled to spousal maintenance.
To establish a claim, the spouse would need to establish there is a shortfall between what money they have coming into their household and what their monthly living expenses amount to. If there is a shortfall, then that shortfall amount could establish a potential claim for spousal maintenance.
It is not available to unmarried couples.
It is normally paid by standing order each month.
It can be increased or decreased if there are changes to the income of either spouse.
The payments will stop if the person in receipt of the spousal maintenance remarries or dies.
An additional condition could also be included for the payments to stop if the recipient has been living with a new partner for a particular period.
