“Can my husband/wife and I just reach a financial agreement between us?” I hear this all the time from clients, and I understand the thinking behind it. They want to retain control over what financial deal is reached and save money on using solicitors.

I’m happy for my clients to have INITIAL discussions with their ex to see what they can agree between themselves.

BUT I always explain –

1. Anything agreed between you is not legally binding so you are relying on trust between you to uphold the agreement you reach.

2. To have your agreement legally binding it needs to be approved by a judge and made into a court order.

3. Judges don’t just approve agreements. They have the authority to turn them down if they don’t like them.

4. To ensure you reach the right financial agreement for you (and one likely to be approved by a judge), it is important

you take legal advice from a solicitor.

5. You need an agreement that works for you not just now but also in the future and divorce solicitors are experienced in how to approach this.

Be careful how you approach this important issue. Using solicitors sensibly doesn’t mean it’s going to cost you a fortune. It can be a false economy to think you can do it all yourself.
