3 options for separated parents to resolve the children arrangements.
When parents separate, they will need to decide how best to continue to parent the children moving forward. The parents have a choice of routes they can take to reach an agreement for the co-parenting arrangements. They can choose the route that suits them best.
The hope is that the parents will be able to reach an agreement between themselves for the parenting arrangements.
If, however, they are unable to reach an agreement, there are options available to assist them.
Here are 3 different ways to record the co-parenting arrangements:
1. An Informal agreement.
This is an agreement reached between the parents themselves. It is often recorded in an email or Word document.
2. A Parenting Plan.
This is a formal document which records the terms of the parenting agreement. It can be prepared by:
- the parents themselves, by downloading a parenting plan template from the internet,
- the family mediator who the couple worked with to reach the agreement, or
- one of the couple’s solicitors.
3. Child Arrangements Order.
If the couple have been unable to reach an agreement using any non-court routes, either parent could make an application to the court.
Then, if no agreement is reached during the court process, the judge will make the final decision.
The decision reached by the judge will be recorded in a court order.
